TAMPA, FL / ACCESSWIRE / April 4, 2024 / On April 1, 2024, the Florida State Supreme Court rendered two crucial decisions that will significantly impact abortion laws in the state. The decisions have sparked discussions and raised concerns within the community.
The first decision upholds the 15-week abortion ban, initially passed in 2022 and subsequently challenged in court. Consequently, the six-week abortion ban (SB 300), passed in 2023, will now become effective on May 1, 2024, making it the prevailing law in Florida. In another significant ruling, the Court has allowed the inclusion of the Floridians Protecting Freedom Abortion Constitutional Amendment on the November 2024 ballot (Amendment 4). The amendment's summary language states: "No law shall prohibit, penalize, delay, or restrict abortion before viability or when necessary to protect the patient's health, as determined by the patient's healthcare provider."

This amendment also removes the parental/guardian consent before a minor has an abortion and would instead move to "notification."
DiMarco also highlighted concerns about the ambiguous language of the amendment and its potential dangers. "Terms like 'before viability,' 'patient's health,' and 'as determined by the patient's healthcare provider' lack clear definitions, posing risks to women's physical and emotional health." He expounded on that by saying, "‘Before viability' can be defined very differently depending on who one is speaking to and the desired outcomes. ‘Patient's health' means physical well-being, but can also include emotional and financial conditions. ‘As determined by the patient's healthcare provider,' can include abortion clinic staff and an abortion doctor. This amendment can be easily abused and is the opposite of freedom."
