The case alleges that Walmart and its senior executives made misleading statements to investors and failed to disclose that: (1) Walmart knowingly filled prescriptions that were issued by so-called "pill-mill" prescribers; (2) Walmart filled thousands of prescriptions that showed obvious red flags, including highly-dangerous cocktails of drugs; (3) Walmart's managers made it difficult for its pharmacists to comply with their legal obligations by pressuring them to fulfill as many orders as possible; (4) hence, Walmart's pharmacy revenues were inflated because Walmart filled thousands of invalid prescriptions in violation of the Controlled Substance Act dispensing requirements; and (5) the aforementioned conduct would subject Walmart to regulatory scrutiny.

Interested Walmart investors have until March 22, 2021 to retain counsel and apply to be a lead plaintiff if they are interested to do so. Investors do not need to be a lead plaintiff in order to be a class member. A lead plaintiff acts on behalf of all other investor class members in managing the class action. If investors choose to take no action, they can remain an absent class member. The class has not yet been certified. Until certification occurs, investors are not represented by an attorney.
