During the class period, Tactile Systems Technology, Inc. allegedly made materially false and/or misleading statements and/or failed to disclose that: (1) while Tactile publicly touted a $4 plus billion or $5 plus billion market opportunity, in truth, the total addressable market for Tactile's pneumatic compression devices was materially smaller; (2) to induce sales growth and share gains, Tactile and/or its employees were engaged in illicit and illegal sales and marketing activities in violation of applicable federal and state rules and public payer regulations; (3) the foregoing illicit and illegal sales and marketing activities increased the risk of a Medicare audit of Tactile's claims and criminal and civil liability; (4) Tactile's revenues were in part the product of unlawful conduct and thus unsustainable; and that as a result of the foregoing, (5) Defendants' public statements, including Tactile's year-over-year revenue growth, the purported growth drivers, and the effectiveness of Tactile's internal controls over financial reporting were materially false and misleading at all relevant times.

Intercept Pharmaceuticals, Inc. (NASDAQ:ICPT)
Class Period: September 28, 2019 - October 7, 2020

The ICPT lawsuit alleges that throughout the class period, Intercept Pharmaceuticals, Inc. made materially false and/or misleading statements and/or failed to disclose that: (i) Defendants downplayed the true scope and severity of safety concerns associated with the use of Ocaliva (obeticholic acid ("OCA")), Intercept's lead product candidate, in treating primary biliary cholangitis; (ii) the foregoing increased the likelihood of a U.S. Food and Drug Administration ("FDA") investigation into Ocaliva's development, thereby jeopardizing Ocaliva's continued marketability and the sustainability of its sales; (iii) any purported benefits associated with OCA's efficacy in treating nonalcoholic steatohepatitis ("NASH") were outweighed by the risks of its use; (iv) as a result, the FDA was unlikely to approve the Company's New Drug Application for OCA in treating patients with liver fibrosis due to NASH; and (v) as a result of all the foregoing, the Company's public statements were materially false and misleading at all relevant times.

HP Inc. (NYSE:HPQ)
Class Period: November 6, 2015 - June 21, 2016
