According to the lawsuit, defendants throughout the Class Period made false and/or misleading statements and/or failed to disclose that: (1) demand for ViewRay systems had declined due in part to changes being made to Medicare reimbursement approaches first announced in November 2018 that could make purchases of new ViewRay systems less profitable for customers; (2) the Company's reported backlog was overstated due to the inclusion of orders with insufficient surety as to permit for their inclusion in reported backlog; and (3) as a result, ViewRay's public statements were materially false and misleading at all relevant times. When the true details entered the market, the lawsuit claims that investors suffered damages.
A class action lawsuit has already been filed. If you wish to serve as lead plaintiff, you must move the Court no later than November 12, 2019. A lead plaintiff is a representative party acting on behalf of other class members in directing the litigation.
