According to the complaint, Defendants misrepresented and concealed that CannTrust was growing cannabis in its Pelham greenhouse facility in five unlicensed rooms between October 2018 and March 2019, and provided inaccurate information to regulators and false and misleading public statements.

On July 8, 2019, the market learned the truth when Defendants disclosed that Health Canada found that the Pelham greenhouse facility was non-compliant with regulations. CannTrust subsequently suspended sales and shipments of its cannabis products. At least one former employee has since reported that fake walls were put up in order to hide the plants, and that staged photos resulted in the regulator not having a visual of the plants. In the wake of the investigation, a number of stores and distributors have decided to pull CannTrust products from online stores and physical outlets.
