German Federal Patent Court Rules ParkerVision '831 Patent Invalid

(OTCQB: PRKR) ("ParkerVision"), a developer and marketer of technologies and products for wireless applications, announced today that the German Federal Patent Court in Munich ("German Court") ruled in a nullity case filed by Qualcomm that ParkerVision German transmitter patent 1 206 831 ("the '831 Patent") is invalid. This ruling was made from the bench following an October 17, 2018 validity hearing in Munich. A final written decision from the German Court is expected in several weeks.

ParkerVision has the option to appeal the German Court's decision to the German Supreme Court. The '831 Patent is the subject of infringement cases against LG and Apple in Germany for products that incorporate Qualcomm chips. These cases were stayed pending the final resolution of the parallel nullity case filed by Qualcomm.

Apple's iPhone 6 and iPad Air 2 were the most recent Apple products incorporating the accused infringing Qualcomm chips. Apple's iPhone 7 and later generation products incorporate different chipsets that are provided by Intel.

The Company has a separate case pending against Apple for its Intel-based products which are accused of infringing ParkerVision German receiver patent 1 135 853 ("the '853 Patent"). The validity decision for the '831 Patent has no bearing on the Company's German case against Apple for infringement of its '853 Patent which covers a separate technology.

The Company also has pending district court cases in the United States against Apple, LG and Qualcomm for infringement of both receiver and transmitter patents.

This ruling has no impact on our German case against Apple for infringement of the '853 receiver Patent by its products incorporating Intel chips. We believe a decision in that case will be reached before the end of this year. The '831 validity decision also has no impact on other pending cases in the U.S. against Apple, LG and Qualcomm which include both transmitter and receiver patents, including the '940 Patent, a transmitter patent which was recently upheld by the Federal Circuit following a PTAB validity challenge by Qualcomm and our '372 Patent, another transmitter patent that survived a validity challenge in an IPR filed by Qualcomm for which the PTAB denied institution of a review."
