As Saunders noted, there are already 6,000 similar cases that are already pending, and the first jury trial is set for this September. As Saunders explained, while DePuy has agreed to pay $2.5 billion to settle issues with the DePuy ASR hip replacement, there is no settlement program yet for the DePuy Pinnacle hip device.
The consumer justice lawyers are also filing Stryker Rejuvenate and ABG lawsuits for hip implant patients who were fitted for the now-recalled products.
In the recently-filed lawsuit, Saunders is representing plaintiffs Dallas R. and Beverly Lavy. Mr. Lavy alleges that he was injured as the result of being fitted with a DePuy Pinnacle Acetabular Cup system.
As Saunders explained, the Johnson & Johnson DePuy artificial hip implant has been recalled due to adverse event reports that between 12 and 13 percent of the hip implants had to be surgically removed and replaced with new implants.
"Neither DePuy nor its parent company, Johnson & Johnson, is disclosing what is wrong with the implants," he said, adding that people suffered from a variety of physical problems including loose cups in the hip socket which caused pain and instability, and allergic reaction to metallic debris in the hip joint.
"Some patients also developed soft tissue masses called pseudo tumors that form as a reaction to exposure to toxins from the metal debris within the hip."
